Accessing information held by the regulator
A parent, educator, staff member or other member of the public may request access to documents held by the government in relation to an early childhood education and care service, school or student exchange organisation.

Information about schools and residual early education and care services
Schools and residual services, regulated under the Education and Early Childhood Services (Registration and Standards) Act 2011, and student exchange organisations, regulated under the Education and Children’s Services Act 2019, may make a request under the Freedom of Information Act 1991 (SA) (FOI Act SA).
Residual services include in-home care, occasional care, rural and mobile care and individual family care services.
A fee may apply to the application. Applicants can apply through the state government form by specifying the Education Standards Board as the relevant agency.

Information about providers and services regulated under the National Quality Framework
Early childhood education and care services regulated under the National Law may make a freedom of information request under the Commonwealth Freedom of Information Act 1982 (Commonwealth FOI Act). This applies to most long day care services, preschool services, out of school hours care services and family day care services.
Information about school providers of international education (CRICOS)
School providers of international education registered on CRICOS (Commonwealth Register of Institutions and Courses for Overseas Students) may make a freedom of information request under the Commonwealth FOI Act.
Applying for Freedom of Information under Commonwealth Law
Under the Commonwealth FOI Act, members of the public can seek access to documents held by the South Australian regulatory authority created under, or for the purpose of: the Education and Care Services National Law Act 2010 or the National Quality Framework (as created under the National Law); or the Education Services for Overseas Students Act 2000.
Your request must:
- be in writing
- state that the request is an application made under the FOI Act
- provide sufficient information about the document(s) that you are seeking to access
- provide an address (email and/or postal) for reply.
There is no fee associated with a freedom of information request under the Commonwealth FOI Act and no processing fees for access to documents containing personal information about the applicant. Processing charges may apply for other requests.

Review of a Freedom of Information Decision
Review of an FOI access decision under the National Law for education and care services
If an individual disagrees with a freedom of information decision, they can seek internal review of the decision by emailing esb.foi [at] sa.gov.au. They can also apply to the National Education and Care Services FOI Commissioner for review of the decision. If a person is not satisfied with the outcome of an internal review, they can also seek review by the National Education and Care Services FOI Commissioner.
If an individual is unhappy with review by the National Education and Care Services FOI Commissioner, they may seek further review through the appropriate administrative tribunal.
Review of an FOI access decision under state FOI law
For review of a freedom of information request under the FOI Act (SA), follow the steps outline in the letter of decision or email the freedom of information officer at esb.foi [at] sa.gov.au.
